TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, REVBOOST FUNDING, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM OR RELATED TO:

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED $100 USD.

9. Indemnification

You agree to defend, indemnify, and hold harmless RevBoost Funding, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or relating to:

• Any loan agreements or transactions you enter with lenders

10. Governing Law and Dispute Resolution

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions.

Venue: Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Fairfield County, Ohio.

Arbitration: Except for disputes that qualify for small claims court, any dispute arising from these Terms shall be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules. The arbitration shall be conducted by a single arbitrator in Ohio. YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTIONS.

11. Privacy and Data Use
